These Terms of Service (“Terms”) are an agreement between you and Tibit. They govern your use of the Tibit mobile application and the website at tibit.ca (together, the “Service”). Please read them carefully. By using Tibit, you agree to them.
1. Acceptance
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use Tibit.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your region) to use Tibit, and old enough to form a binding contract. If you’re using Tibit on behalf of someone else, you confirm you’re authorized to accept these Terms for them.
3. The Service
Tibit delivers one idea each day, a concept paired with a quote, with an optional reveal, ratings, and a personal library. Tibit is for general education and reflection only. It is not professional advice of any kind, whether financial, medical, legal, psychological, or otherwise, and you should not rely on it as a substitute for a qualified professional. We curate content carefully but do not guarantee it is complete, current, or free of error.
4. Your account
You’re responsible for the accuracy of your account information and for keeping your credentials secure. You’re responsible for activity that happens under your account. Tell us promptly at support@tibit.ca if you suspect unauthorized use.
5. Subscriptions, free trial, and billing
Tibit offers an optional paid subscription (“Tibit Pro”), available on monthly and annual plans. New subscribers may be offered a 3-day free trial. Current prices vary by region and are shown in the app before you purchase or start a trial.
- Billing through Apple. Subscriptions are sold and billed through your Apple App Store account. Payment is charged at confirmation of purchase (or at the end of any free trial).
- Auto-renewal. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Free trial. If you don’t cancel before your free trial ends, it converts to a paid subscription and you’ll be charged. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.
- Managing and cancelling. You can manage or cancel your subscription anytime in your Apple App Store account settings. Deleting the app does not cancel your subscription.
- Refunds. Purchases are handled by Apple and are subject to Apple’s refund policies; we generally cannot grant refunds directly. Nothing here limits any non-waivable refund or cancellation rights you have under applicable consumer law.
- Price changes. We may change subscription prices. Changes apply to future billing periods and, where required, we’ll give you advance notice and the chance to cancel.
6. Acceptable use
You agree not to:
- copy, scrape, resell, or redistribute Tibit’s content except as the app expressly allows;
- reverse-engineer, interfere with, or attempt to gain unauthorized access to the Service or its systems;
- use the Service to break the law or infringe anyone’s rights; or
- upload content that is unlawful, abusive, or violates the rights of others.
7. Intellectual property
The Service, including its software, design, and original editorial content, is owned by Tibit and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms. Quotations are attributed to their respective authors and sources and remain the property of their owners.
8. Your content
Reflections, notes, or other content you create stay yours. You grant Tibit a limited licence to store and display that content solely to operate the Service for you. You’re responsible for the content you create and confirm you have the right to share it.
9. Feedback
If you send us ideas or suggestions, we may use them to improve Tibit without any obligation to you.
10. Third-party services
Tibit relies on third parties, including Apple and our service providers for hosting, subscriptions, and analytics, whose own terms and policies may apply. We aren’t responsible for third-party services we don’t control.
11. Apple App Store terms
These Terms are between you and Tibit only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app (including product-liability claims, failure to conform to legal requirements, or consumer-protection claims) are our responsibility, not Apple’s. You agree to comply with the App Store Terms of Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don’t warrant that the Service will be uninterrupted, error-free, or that content is accurate or reliable for any purpose.
13. Limitation of liability
To the fullest extent permitted by law, Tibit and its team won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold Tibit harmless from claims, damages, and reasonable expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.
15. Termination
You can stop using Tibit and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could harm Tibit or others. Provisions that by their nature should survive termination will survive.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts of Ontario will have jurisdiction over disputes, except where applicable law gives you the right to bring a claim in your local courts. Nothing in these Terms limits your mandatory consumer-protection rights in your place of residence.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after a change means you accept the updated Terms.
